April 2025: new Fiscal Transparency Regime applies to all taxpayers
Argentina’s new Fiscal Transparency Regime for Consumers (RTFC) rules have been extended to small business from 1 April 2025.
On 13 December 2024, Argentina’s Customs Collection and Control Agency (ARCA) published General Resolution No. 5614/2024, implementing the under Law No. 27.743. This regulation introduces new invoicing requirements for businesses, aiming to enhance consumer awareness of the tax components included in the final price of goods and services.
The RTFC seeks to improve transparency by clearly showing consumers the VAT and other indirect national taxes embedded in retail prices. It promotes informed purchasing, tax awareness, and economic formalization.
Phased 2025 introduction
All registered VAT taxpayers—excluding those under the Simplified Regime (monotax payers)—must comply. The regime was implemented in two phases:

1 January 2025: Mandatory for large businesses; voluntary for SMEs.

1 April 2025: Mandatory for small and medium enterprises.
Invoice disclosure requirements

Tax Itemisation: Businesses must break down VAT and other indirect taxes on every electronic invoice or receipt issued to final consumers.

Standardised details: Each document must include a clear section with the VAT amount and the mandatory phrase:
“Fiscal Transparency Regime for Consumers – Law 27.743.”

Price Details: The use of misleading marketing terms like “free” for taxable items is prohibited.

Future disclosures: Although provincial taxes (e.g., gross income or municipal taxes) are not yet displayed, their inclusion is expected over time.
Penalties for non-compliance
Non-compliance may result in temporary business closures (2–6 days) as per Argentina’s Tax Procedure Law. Businesses are strongly advised to ensure systems and practices are updated to meet the regime’s standards.
Challenges for SMEs
Small and medium-sized businesses face increased compliance obligations, including:

Updating billing systems and staff training.

Adjusting accounting practices, especially in sectors like healthcare.

Absorbing the removal of VAT exemptions, such as those for printed periodicals.
