Spain fuel VAT cut triggers EU challenge

European Commission warns Spain over fuel VAT cut from 21% to 10%, breaching EU VAT Directive rules on fuel supplies

The European Commission has formally warned Spain that its emergency reduction of VAT on fuels from 21% to 10% is incompatible with the EU VAT Directive. In a letter issued on 28 March 2026, Brussels reiterated that reduced VAT rates cannot be applied to fuel supplies under the Directive, even in periods of economic stress. While the Commission acknowledged the pressure on households from surging energy costs linked to the Iran conflict, it stressed that Member States must respect harmonised VAT rules to avoid distortions in the single market.

VAT cut with other emergency measures

The measure was introduced by the government of Pedro Sánchez as part of a broader €5 billion emergency package approved via royal decree-law. Alongside the VAT reduction, Spain also cut excise duties on petrol and diesel to the minimum thresholds permitted under EU legislation. The temporary 10% VAT rate applies not only to fuels, but also to electricity, natural gas, charcoal briquettes and wood pellets, reflecting the wider energy cost pressures facing consumers and businesses.

The Commission has made clear that excise duty adjustments remain the appropriate legal mechanism for intervention, rather than VAT rate changes. A spokesperson confirmed on 8 April that the Commission is now awaiting Spain’s formal response, with ongoing dialogue described as “constructive”.

Spain’s reduced VAT rate is scheduled to expire at the end of June 2026, with a reversion to the standard 21% rate from 1 July unless extended. No infringement proceedings have yet been initiated. However, if Spain maintains the reduced rate beyond the temporary window, or fails to align with EU law, the Commission may escalate to formal legal action, including referral to the Court of Justice and potential financial penalties.

Poland has taken a similar approach, cutting VAT on fuels from 23% to 8% from 31 March, alongside excise reductions, with the aim of lowering pump prices by approximately PLN 1.20 per litre.
